- GENERAL TERMS AND CONDITIONS
- 1 Basic Provisions
(1) These terms and conditions apply to contracts entered into with Benicon GmbH, the provider, via the website www.tebux.com. Any additional terms and conditions used by the customer are not accepted unless otherwise agreed.
(2) A “consumer” refers to a natural person concluding a transaction for purposes not related predominantly to their commercial or independent professional activity. An “entrepreneur” refers to a natural or legal person or a partnership with legal capacity acting within the scope of their independent professional or commercial activity.
- 2 Conclusion of the Contract
(1) The contract involves the sale of goods.
(2) By placing a product on our website, we present a binding offer to enter into a contract via the online shopping cart system, subject to the conditions outlined in the item description.
(3) The contract is concluded via the online shopping cart system as follows:
- Goods intended for purchase are placed in the “shopping cart.”
- You can access and modify the “shopping cart” at any time.
- After entering personal data and payment/shipping conditions on the “Checkout” page, the order details are displayed as an overview.
- If using an instant payment system, you will be directed to the system’s website for order confirmation.
- By submitting the order, you legally accept the offer, completing the contract.
(4) Customer requests to create an offer are non-binding. We will provide a binding offer in text form (e.g., email), valid for 5 days.
(5) Order processing is partially automated via email. Ensure your provided email is correct, receives emails, and is not hindered by SPAM filters.
- 3 Right of Retention, Retention of Title
(1) A right of retention is only applicable to claims from the same contractual relationship.
(2) Goods remain our property until the full purchase price is paid.

(2) As a consumer, check goods immediately upon delivery for completeness, obvious defects, and transport damage. Report any issues to us and the freight forwarder promptly.
(3) If a feature deviates from objective requirements, it’s agreed upon only if communicated to you before the contract declaration and expressly agreed upon.
- 5 Choice of Law, Place of Performance, Place of Jurisdiction
(1) U.S. law applies. For consumers, this choice of law applies to the extent it does not withdraw protection granted by mandatory provisions of the consumer’s country.
(2) Place of performance and jurisdiction is our registered office. For consumers, it applies if they are not merchants, legal entities, or public law entities.
(3) UN Convention on Contracts for the International Sale of Goods does not apply.
- 6 Protection of Minors
(1) For goods under Youth Protection Act, contracts are only with customers meeting the required minimum age. Age restrictions are indicated in the item description.
(2) By ordering, confirm reaching the legally required minimum age and provide correct name and address details.
(3) If an age check is required, the logistics service provider will ensure handover only to individuals of legal age.
(4) If item description requires being 18 years or older, the above applies with majority replacing the minimum age.

2.1. The contract language is English.
2.2. We do not save the complete contract text. Before submitting the order, contract data can be printed or saved electronically. After receiving the order, order data, required distance selling information, and terms will be sent by email.
2.3. If you request an offer, all contract data will be provided in a binding offer in text form, e.g., by email.

5.1. Prices and shipping costs are total prices, including applicable taxes.

5.3. Any costs for money transfer are borne by you in cases of EU delivery with payment made outside the EU.

5.5. Payment claims are due immediately unless stated otherwise.

6.2. Risk of loss and deterioration of goods during shipment passes to you when handed over.
